Crosswords Without Pity


Hello, I have a simple question if anyone remembers this puzzle.
There was a puzzle (I don't know when it appeared in the NYT; I do the puzzle in a local newspaper) to which I only saw the answers, and one of the answers could be either "BLACK" or "WHITE" (depending on how you filled in the down answers), and I was curious as to how this was clued.
I appreciate it!

Obviously, mega-spoilers here:

Shade of 17- and 57-Across: BLACK/WHITE (The two referenced answers were EMPERORPENGUINS and DAILYNEWSPAPERS.)
Had on one's back = BORE/WORE
Not open = SLY/SHY
Skewer = PAN/PIN
Home, for one = PLACE/PLATE
Construction site sights = CRANKS/CRANES

To anyone who is reading this - well, both of you - I would have made a new post but I couldn't figure out how to do that.

(I'm not all that bright).

Anyway, did anyone else notice a recent LAT that used the word 'UP' in three different places - all coincidentally?

Thought that was odd.

I know. No big thing.
